Welcome to 406 Notary Service. By accessing or using our website ("Site") or purchasing our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Services Provided

406 Notary Service provides professional notarization, authentication, and local officiant services, including:

Remote Online Notarizations (RON)
Remote Ink-Signed Notarizations (RIN)
Mobile Notarization Services (within a 60-mile radius of Sun Prairie, MT)
Apostille Tracking & Authentication Coordination Services
Document Printing & Courier Services
Local Wedding Officiant Services

Services may be facilitated using secure third-party technology platforms such as Pactima, Notarize/Proof, TidyCal, Zoom, or other digital portals.

2. User Responsibilities & Identity Verification

You agree to provide accurate, complete, and current information when scheduling services or submitting documents.

For all remote notarization sessions (RON/RIN), clients must establish their identity prior to or during the session in accordance with Montana Secretary of State standards using one of the following methods:

Government-Issued Identification & Biometric Proofing: Passing secure identity proofing and credential analysis using an unexpired, government-issued photo ID (such as a driver’s license or passport). To verify your identity, our third-party technology platforms may collect and process biometric data (such as facial geometry scans, facial recognition, and live camera photo matching) to verify that your face matches the presented ID card. By scheduling a session, you explicitly consent to the collection, processing, and temporary storage of biometric verification data by our technology providers for identity verification purposes.
Credible Witness Verification: If a client has an expired ID or lacks acceptable government photo identification, identity may be established using a qualified Credible Witness. The Credible Witness must be an unbiased third party who personally knows the user, can satisfactorily prove their own identity through approved verification protocols (which may include biometric proofing), and execute a sworn statement during the recorded session in compliance with Montana administrative rules.

International & Non-U.S. Signers Note: Remote identity verification systems (including Knowledge-Based Authentication) may require a U.S. Social Security Number or established U.S. credit history. If an international client cannot pass automated identity or biometric proofing and cannot provide a qualified Credible Witness, the session cannot proceed.

Failure to satisfy identity verification requirements—by failing ID verification, biometric checks, KBA, or failing to provide a qualified Credible Witness—voids the notarization session without a refund. You are entirely responsible for complying with all applicable local, state, national, and international laws and regulations.

3. Payment & Booking Terms

Payment Methods: Payments are securely processed through Stripe, Square (including ACH and Cash App), and Venmo.
Upfront Retainers & Clearing: Full payment or a non-refundable upfront retainer is required to officially reserve an appointment window or initiate Apostille processing.
Refund Policy: All fees and retainers are strictly non-refundable once an appointment window is locked, document processing has commenced, or a session is voided due to failed identity verification.

4. Multi-Jurisdiction Logistics, Shipping, and Hague Contingencies

International and multi-jurisdiction orders are subject to the following logistical guardrails:

Split-Jurisdiction Processing & Fees: If signers are positioned in different geographic zones or require physical certified copies processed through multiple state or federal offices, additional government application fees, Apostille processing surcharges, and individual courier fees will apply.
Physical Courier & Wet-Ink Holds: Standard digital deliveries are executed rapidly online. If your destination country or receiving agency rejects electronic documents and requires physical wet-ink or gold-embossed copies, physical dispatch will be held mid-session until carrier shipping labels (FedEx/UPS/DHL) and courier surcharges are itemized and paid in full.
Non-Hague Country Legalization: Documents bound for countries not party to the Hague Apostille Convention require multi-tiered federal and consular routing (U.S. Department of State and foreign Embassy/Consulate seals). These orders are subject to extended timelines and custom fee adjustments based on changing embassy mandates.
Foreign Acceptance Disclaimer: While we ensure all notarizations and Apostille filings comply strictly with Montana law and federal standards, 406 Notary Service does not warrant or guarantee that a foreign government, embassy, foreign court, or private foreign institution will accept a specific document format. Acceptance rules are solely determined by the receiving jurisdiction.

5. Non-Attorney / No Legal Advice Disclaimer

406 Notary Service and its representatives are not attorneys and are not licensed to practice law in Montana or any other jurisdiction. We do not provide legal advice, draft legal documents, or advise on the legal effect or foreign suitability of any document processed through our services. For legal questions regarding document drafting, international validity, or tax implications, consult a qualified legal professional in the appropriate jurisdiction.

6. Third-Party Platform Use

When accessing services through third-party platforms (e.g., Notarize/Proof, Pactima, TidyCal, Zoom), you are also subject to those platforms' native terms of use, data security frameworks, and privacy policies.

7. Limitation of Liability

To the maximum extent permitted by law, 406 Notary Service, its members, and operators shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services. This includes, but is not limited to: scheduling delays, failed identity verifications, visa rejections, foreign municipal registry denials, foreign bank rejections, or shipping transit delays caused by third-party couriers.

8. Changes to Services and Terms

We reserve the right to modify or discontinue any service, adjust surcharges, or revise these Terms at any time to reflect changing state, federal, or embassy frameworks. Changes are effective immediately upon posting to the Site.

9. Governing Law & Exclusive Venue

These Terms shall be governed by, interpreted, and enforced in accordance with the laws of the State of Montana, without regard to its conflict of law principles. You expressly agree that any legal action, dispute, or proceeding arising out of or relating to these Terms or our services shall be filed exclusively in the state or federal courts located in the State of Montana, and you hereby consent to the personal jurisdiction of such courts.
